Welcome to the mybiOSis Project website ("mybiosis.info", "kladia.info", "trillia.info" or the "Website"),
Nature Digital Object Repository (or NDOR) database, web applications, or mobile applications created by partners (myNature Association, BIODIV.SYSTEMS S.R.L. or KLADIA.STUDIO S.R.L.). The Website is owned and operated by the MYNATURE ASSOCIATION (or MYNA). The web applications inside kladOS/website are created by or created for entities specified in their about software section. The Mobile apps (i.e. Macrophte.Mapper, WaterBodyStructure.Mapper, natRec) are created by or created for entities specified in the about within the applications.
The Website, web applications or mobile applications are offered subject to Your acceptance without modification of
all of the terms and conditions contained herein including the
Privacy Policy at https://kladia.info/klados/privacy_policy.php.
Please read this Agreement carefully before accessing or using the Website.
By accessing or using any part of the Website, each user ("You" or "Members") agrees to the
terms and conditions of this Agreement. If You do not agree to all the terms and conditions of this Agreement,
You should not access the Website or use any services made available via the mybiOSis
Project and/or MYNA servers (https://kladia.info and https://trillia.info) or mobile applications.
Your mybiOSis Account
If You create an account on the Website or mobile applications, You are responsible
for maintaining the security of Your account, and You are fully responsible for
all activities that occur under the account and any other actions taken in
connection with the account. mybiOSis Project administrators may, at discretion,
remove any content that is considered inappropriate or unlawful. MybiOSis Project or
MYNA will not be liable for any acts by You, including any damages of any kind
incurred as a result of such acts.
Please make sure that Your user name is not named in a manner that misleads
Your readers into thinking that You are another person or company or contains inappropriate words.
Contribution rules
If You post Content to the Website (or allow any third party to make), You are entirely
responsible for the content of, and any harm resulting from, that Content. That is the
case regardless the type of Content (text, graphics, audio files, etc.).
Rules to be met when posting/uploading Content on Website and NDOR:
- You agree that you are participating and submitting content in good faith.
- You own and control all of the rights to the Content that You post or You otherwise have the right to post such Content to the Site.
- the Content is accurate and not misleading and will NOT violate any rights of or cause injury to any person or entity.
- the Content does not contain or install any viruses, malware, Trojan horses or other harmful or destructive content.
- the Content is not spam and does not contain unethical or unwanted commercial content.
- You will post only Content that is relevant to mybiOSis and at a rate and volume that does not hinder other Users' ability to use mybiOSis.
- You will not post redundant Content. Series of redundant digital objects (images, graphics, audio files etc.) are not usually accepted and may be removed at discretion of mybiOSis Project administrators.
- the Content is not defamatory, does not contain political propaganda, threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party.
- Your Content is not getting advertised via unwanted electronic messages such as
spam links on newsgroups, email lists, journals and web sites, and similar unsolicited promotional methods.
By submitting Content to mybiOSis Project for inclusion on the Website and NDOR, You grant mybiOSis a world-wide,
royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish the Content solely
for the purpose of displaying, distributing, and promoting Your observations via mybiOSis Website or associated mobile applications.
We might also use the Content for other purposes not subject to known legal restrictions,
such as training machine learning software (AI).
Your Content will always remain yours and you can delete it at any time.
If You delete Content, mybiOSis will use reasonable efforts to remove it from the Website, but
You acknowledge that caching or some references to the Content may not be made unavailable.
Back-up copies may remain in our databases for quite some time, but will not be accessible to the public.
Any Content you contribute to the Website or NDOR via the Website or a mobile application will
be available to everyone who uses the Website or related mobile application. However, within the Website or mobile applications,
you would find means for restricting/expanding the visibility or setting the ownership of your Content.
If you are not comfortable with this, don't use this service.
Think before you post any information that would identify you personally to the site,
including your full name, your home address, telephone number, email address, or school.
If you are under age, do not post this information to the site at all.
mybiOSis administrators have not reviewed, and cannot review, all of the material,
including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects.
You will not threaten, abuse, solicit, spam, harass, impersonate or intimidate other Website
members and not collect or store any location or other personal information about any Website
members that You obtain from the Website.
By operating the Website, mybiOSis does not represent or imply that it endorses the material
posted to the Website, or that it believes such material to be accurate, useful, non-infringing or non-harmful.
You are responsible for taking precautions as necessary to protect Yourself and Your computer systems from viruses,
worms, Trojan horses, and other harmful or destructive content.
Copyright Infringement
mybiOSis Project respects the intellectual property rights of others, and requests
that Members of the mybiOSis Website, services and mobile applications do the same.
If You believe that Your work has been copied on the Website in a way that
constitutes copyright infringement, please provide mybiOSis administrators
with the specific information (please use the following email address for such notifications: infoATmybiosis.info).
It is in mybiOSis Project’s policy to respond for clearing the notifications of copyright infringement.
Intellectual Property
All trademarks, graphics and logos used in connection with mybiOSis Project or
the Website are trademarks or registered trademarks of MYNA or other third parties.
Your use of the Website grants You no right or license to reproduce or otherwise use
any MYNA or third-party trademarks. This Agreement does not transfer to
You any of mybiOSis Project, MYNA, or third party intellectual property, and all right,
title and interest. The rights on such property will remain solely with mybiOSis Project, MYNA, or such owners.
No Commercial Use
You agree not to use the Website, the mybiOSis Project or NDOR, or any mybiOSis Content for commercial
purpose or for any illegal, unlawful, inappropriate, or unauthorized purpose or activity.
Termination
mybiOSis Project may terminate Your access to all or any part of the Website at any time,
with or without cause, with or without notice, effective immediately. If You wish to terminate this
Agreement or Your mybiOSis Project account, You may simply discontinue using the Website and delete
Your account. All provisions of this Agreement which by their nature should survive termination
shall survive termination, including, without limitation, ownership provisions,
warranty disclaimers, indemnity, and limitations of liability.
Disclaimer of Warranties
The Website is provided “as is.” mybiOSis Project, Partners, its suppliers, and Members hereby
disclaim all warranties of any kind, express or implied, including, without limitation,
the warranties of merchantability, fitness for a particular purpose and non-infringement.
Neither mybiOSis Project nor its suppliers or Members makes any warranty that the Website
will be error free or that access thereto will be continuous or uninterrupted.
You understand that You download from, or otherwise obtain content or services through,
the Website at Your own discretion and risk.
Limitation of Liability
In no event will mybiOSis Project, MYNA, or its Partners be liable with respect to any
subject matter of this Agreement under any contract, negligence, strict liability or other
legal or equitable theory for: any special, incidental or consequential damages, the cost of procurement or substitute products or services, or
for interruption of use or loss or corruption of data.
mybiOSis Project, MYNA, or its Partners shall have no liability for any failure or delay due
to matters beyond its reasonable control.
Warranty
You represent and warrant that:
Your use of the Website will be in strict accordance with the mybiOSis Project
Privacy Policy located at https://kladia.info/klados/privacy_policy.php with this
Agreement and with all applicable laws and regulations.
Your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
Changes
mybiOSis Project reserves the right to modify or replace any part of this Agreement.
It is Your responsibility to check this Agreement periodically for changes.
Your continued use of or access to the Website following the posting of any changes
to this Agreement constitutes acceptance of those changes. mybiOSis Project may also,
in the future, offer new services and/or features through the Website (including,
the release of new tools and resources). Such new features and/or services
shall be subject to the terms and conditions of this Agreement.
